ZillyO — Terms of Service

1. About this store

Welcome to ZillyO. The ZillyO online store at https://www.zillyo.com (the “Store”) offers clothing, accessories, and related merchandise. The Store is operated by ZillyO (referred to here as “ZillyO,” “we,” “us,” or “our”) and uses Shopify’s commerce platform. By visiting or making a purchase through the Store, you agree to these Terms of Service, subject to your rights under applicable law. If you do not agree, do not use the Store.

2. Products and descriptions

We work to present product photography, artwork, colors, sizing, availability, pricing, and descriptions accurately. Displayed colors and proportions can vary depending on your screen. Please review each item’s size guide and details before ordering. Product information, options, and availability may change. We may correct genuine errors and contact you about any material discrepancy in an order; we will not substitute materially different items without appropriate authorization.

Some products, including graphic T-shirts, are printed or produced after you order. Products labeled as concepts or upcoming releases on editorial or gallery pages are not offered for sale unless they also appear as purchasable items in the Store.

3. Ordering and payment

Prices are stated in the currency shown at checkout. Shipping, applicable taxes, and any other charges are displayed before payment. Submitting an order does not guarantee availability or acceptance; we may contact you if there is a payment, availability, verification, or other legitimate problem. If we cannot fulfill an accepted paid order, we will provide an appropriate refund or resolution consistent with applicable law.

You agree to provide accurate billing, delivery, and contact information. Payments are processed by our available third-party payment providers. We do not ask customers to send payment-card information by email.

4. Production, shipping, and delivery

Made-to-order graphic T-shirts normally require an estimated 2–5 business days of production before shipment; this is an estimate rather than a guarantee. Shipping costs, available services, and estimated transit times vary by item and destination and are displayed at checkout. Orders may be sent in separate shipments.

For full details, see our Shipping Policy. If there is a discrepancy in an estimated date, please contact us so we can clarify the order’s status. Statutory delivery rights are not limited by these Terms.

5. Returns, damaged items, and refunds

Because certain products are made to order, change-of-mind returns and exchanges may be limited, subject to applicable consumer laws. If an item arrives damaged, defective, misprinted, incorrect, or materially different from the ordered item, contact us promptly with your order number and relevant photos. Our Refund Policy explains the claim process, remedies, and timing. These Terms do not restrict your non-waivable legal rights.

6. Intellectual property

The ZillyO name, original character artwork, Blinded By Cash Gang creative materials, editorial graphics, product designs, and website content are owned by ZillyO or their respective rights holders and are protected to the extent permitted by applicable law. You may browse the Store for personal, noncommercial purposes. You may not copy, sell, reproduce, or use our original artwork or website materials commercially without permission. No license to any trademarks, characters, or designs is granted by purchasing an item.

7. Your use of the Store

Do not misuse the Store, attempt to interfere with its security or operation, submit fraudulent transactions, upload malicious code, violate others’ rights, or use our content unlawfully. We may take proportionate action to protect the Store, customers, and our rights, subject to applicable law.

8. Third-party services

The Store uses third-party providers, including Shopify, payment processors, carriers, and print-on-demand fulfillment partners. Their separate terms may apply when you use their optional services. We are responsible for fulfilling our own legal obligations to customers, including applicable consumer-protection requirements, regardless of the fulfillment partners we use.

9. Privacy

We handle personal information according to our Privacy Policy. Please review it for details about collection, use, and sharing of information associated with orders and visits.

10. Errors, service changes, and availability

We may update Store content, correct mistakes, and change or discontinue products or site features. We do not guarantee that the website will be uninterrupted or error-free. Nothing in these Terms excludes or restricts liability or rights where doing so would be unlawful.

11. Applicable law

These Terms are intended to be interpreted in accordance with applicable United States law and the laws of Minnesota, subject to any mandatory consumer-protection rules that apply in the customer’s jurisdiction. No mandatory arbitration or class-action waiver is imposed by these Terms.

12. Changes to these Terms

We may update these Terms occasionally. The version posted on the Store will identify its last updated date. Material changes will apply prospectively to the extent required by law and will not retroactively remove rights that have already arisen from completed purchases.
